What if a loved one is special needs?
A disability or other special need should affect the support, supervision, and emergency planning that goes into a loved one’s school or care facility experience.
IF SOMEONE IS INJURED, SEEK MEDICAL ATTENTION.
Don’t delay medical care to document an incident. Once care is obtained, document the incident, incidents, or injury. Make sure to retrieve all information regarding your loved one’s disability, and any correspondence about it. A Lawyer can help organize evidence and create a plan.
Here are some guidelines:
Gather existing records and plans. Relevant records may include an IEP, Section 504 plan, health plan, transportation instructions, and medical orders.
Identify what staff knew and what occurred. Compare the established instructions with incident reports, communications, and witness accounts.
Describe changes from your loved one’s usual abilities. Document new symptoms, reduced participation, additional assistance, and changes in treatment.
A school report, possible criminal conduct, and a civil claim require different assessments. In each, follow-up is crucial. Focus on your family’s needs. Understand that school support plans and injury-related issues may require coordinated review.
