What should I do after a nursing home injury?

After a nursing home injury, getting medical care and properly reporting what happened help establish the record your claim needs.

IF YOU OR A LOVED ONE IS INJURED, SEEK MEDICAL ATTENTION.

Safety and medical care come first. Call 911 when someone is injured. Gathering evidence should not delay emergency care.

REPORT THE INJURY PROMPTLY.

If you are a loved one has suffered a nursing home or care facility injury, focus on your medical needs and creating a clear record of what happened. Keep notes about what happened, visible injuries, changes in condition, and conversations with staff. Identify whom you notified and what response they gave.

Use the appropriate reporting channels. Raise concerns with facility management. Maryland’s Office of Health Care Quality investigates complaints about regulated care facilities.

SAVE ALL MEDICAL AND FACILITY RECORDS.

Ask the facility to preserve relevant reports, photographs, and video. Make sure to tell the insurance provider that the injury happened at a care facility. Save all notes, restrictions, treatment recommendations, and dates of stay at different providers.

WHAT CAN I EXPECT MOVING FORWARD?

Navigating records requests, treatment timelines, and care providers can be difficult. Meet with a qualified Attorney, who can explain your claim’s status, any issues, and what information is still needed. Your lawyer can explain which additional steps may be needed to pursue a legal claim.
