What happens after a Demand is received?
Sending a Demand Package is only the first part of the process. Once it has been received, insurance companies begin the task of evaluating your claim. They will begin investigating the claim as a whole, including the Demand Package, Liability, and any supporting evidence. They will also seek their own evidence, and the goal for them is to determine how strong your case is and what it’s worth to them.
WHY CAN THIS TAKE A LONG TIME?
Even when cases are straightforward, the opposing parties can take a long time to reply to a Demand. While the evidence may seem clear-cut to us, insurance companies want to critically examine your claim before they are even willing to begin negotiation.
After their deliberation, they can reply in several ways:
Claim Accepted
This means the insurance company accepts liability (admits they’re on the hook). It’s undecided for how much, but they agree with you that compensation is awarded.
Claim Contested
The insurance company disputes the claim, and this can be because they feel they aren’t entirely responsible, your medical treatment was unneeded or unrelated, or for many other reasons.
Claim Rejected
The claim had clerical errors and couldn’t be processed. This is rare.
Claim Denied
The insurance company denies liability, coverage, or both.
Sometimes, we file a claim even when we know what their response is going to be. It’s okay if your claim wasn’t accepted right away. We are prepared to do whatever it takes to make things right.
