Do I have a Workers' Compensation Case?

A work injury may qualify for workers’ compensation, but the circumstances of the injury and your employment matter.

WHAT LED TO YOUR INJURY?

Our first task is to determine what the extent of your injuries are. We use that information and explain how it happened in connection with work. We ask questions like:

  • What you you doing?

  • Where were you?

  • How did the injury occur?

  • What could have prevented this injury?

NEXT, WE EXPLAIN HOW YOU ARE COVERED BY INSURANCE.

In most cases, your employer carries legally-mandated insurance policies. However, things can get more complex as a contracted employee, self-hire, or freelancer. Speak with a legal professional for more information. A job title or contractor label does not resolve every coverage question.

Other things that can complicate a case are long-term workplace illnesses, pre-existing conditions, specific details surrounding the event, and policy coverage limits.

WORKERS’ COMP IS VERY DIFFERENT FROM PERSONAL INJURY.

While Personal Injury cases generally resolve through settlement long before reaching a courtroom, a Workers’ Comp case is completely different, and involves a State Commission. There are different sets of rules for these cases, and it can be difficult to navigate alone. Contact us for a free consultation.
