What if the other driver has no insurance?
IF THE OTHER DRIVER IS UNINSURED, THE NEXT STEP IS REVIEWING OTHER POSSIBLE SOURCES OF COVERAGE.
Your first priorities after a car wreck are getting help, protecting your safety, and keeping an accurate record of what happened.
IF YOU ARE INJURED, SEEK MEDICAL TREATMENT.
Safety and medical care come first. Call 911 when someone is injured. Move out of traffic if you can do so safely. Gathering evidence should not delay emergency care.
NEXT, SAFELY GATHER EVIDENCE; TAKE PICTURES, VIDEO, AND OBTAIN DOCUMENTS.
Missing an insurance card, being unable to identify a carrier, and receiving a coverage denial are different situations. Collect the driver’s information. Save witness contacts, photographs, and retrieve any police incident reports. Include vehicle positions, damage, and road conditions whenever possible. Describe whether you were stopped, slowing down, changing lanes, or involved in a chain of impacts.
If you have questions, contact us for a free consultation. Applicable policies may provide protection when the responsible driver is uninsured. The claim still requires supporting evidence and compliance with policy requirements. When no coverage is available, Maryland Auto’s Uninsured Division may help.
EVEN IF YOU AREN’T SURE, AN ATTORNEY MAY MAKE A HUGE DIFFERENCE IN YOUR CASE.
Follow through afterward. Notify your insurer promptly, follow your medical provider’s recommendations, and keep treatment records, receipts, and information about missed work. If you or a loved one have been severely injured, it may make sense to allow a qualified Attorney to take on your case while you focus on recovery.
WHAT'S SHOULD I EXPECT MOVING FORWARD?
Stay in communications with your medical provider, insurer, and legal team. An adjuster may request details or inspect the damage to your vehicle. What the client should expect: Your lawyer may need to review several policies or programs before identifying the correct path. Expect questions about the vehicles, drivers, available insurance, and circumstances of the collision. Keeping claim numbers, documents, and notes about conversations together makes follow-up easier.
