What is UM/UIM?
UM - UNINSURED MOTORIST COVERAGE
UIM - UNDER-INSURED MOTORIST COVERAGE
In Maryland, state law requires all auto insurance policies to include both of these types of coverage. Uninsured and underinsured motorist coverage can help when the driver responsible for an accident has no insurance or insufficient insurance. To restate, UM and UIM are an automatic part of YOUR auto insurance policy, not someone else’s.
UM ADDRESSES UNINSURED DRIVERS; UIM ADDRESSES INSUFFICIENT COVERAGE.
UM applies when you are hit by a driver who has no liability insurance at all, by a driver in a hit-and-run, or in any incident where the driver is unidentified.
UIM applies when you are hit by a driver who does have liability insurance, but their policy limits are too low to cover the full extent of your medical bills and damages. Your UIM coverage typically only pays the gap between what the other driver's insurance paid and what you are owed.
COVERAGE DOES NOT GUARANTEE PAYMENT.
In the end, Liability, injuries, applicable policies, and those policy limits still matter. It may be in your best interest to make an injury claim through UM/UIM even though another driver caused the accident. Speak with a lawyer, as they can help coordinate insurers to maximize payout. Make sure you have all the facts before accepting a settlement or signing a release.
